Plaintiff v. Commercial Trucking Company, spine surgery

Kevin O’Hara helped obtain a $6.8 million verdict by doing pre-trial work and the trial direct examination of the treating surgeon in this case. This case involved a semi-truck driver smashing two women on the freeway, causing minor physical injuries to one, severe physical injuries to the other, and severe emotional injuries to both. Defendants disputed liability on the rear end accident.

Plaintiff v. individual defendant, spine surgery

Kevin O’Hara obtained a $333k verdict on a third-party arbitration case with heavily disputed medicine and a low speed collision to a parked car with almost no property damage. Defense asked for $20,000 in closing argument. Due to a Statutory offer to compromise from earlier in the case, the total recovery included costs and expert fees, and exceeded $500k.

Infant v. Car Seat Manufacturer | Products Defect/Catastrophic Injury

Kevin helped obtain a confidential 7 figures settlement in a hotly contested products liability case involving a defective car seat latching mechanism. One of the major issues in this case was the comparative fault of the infant’s father, who failed to adequately secure the car seat. This case involved dozens of depositions, motions for summary judgment, and other attorney work before settling just before trial.

Plaintiff v. Commercial Company | Traumatic Non-surgical Injuries

Plaintiff lost the use of one of his arms when he was involved in a horrific motorcycle crash. The insurer failed to pay the policy limits of $25k and ultimately conceded that they committed bad faith after the case resolved for $10.5 million at mediation. In deposition, medical professionals opined that Plaintiff had lost the effective use of one of his arms.

Plaintiff v. Anonymous | Bad Faith

On a $100k policy, Kevin took this one to the eve of trial and obtained $790k more than the policy limits. This was a disputed medical liability case, where the defense believed Plaintiff only suffered a soft tissue injury and received an unnecessary neck surgery. Kevin handled all aspects of this case, including depositions, motion work, and preparation for trial.

Plaintiff v. Elevator Servicing Co & Hotel | Premises Liability

This case involved an elevator malfunction. Plaintiff fell when the elevator suddenly dropped. The impact was relatively minor, but the fall aggravated a pre-existing injury in Plaintiff’s neck. The medicine and liability in this case were both hotly contested, and as lead counsel Kevin spent over 700 hours taking dozens of depositions and defeating motions for summary judgment against both defendants.

Kevin fought to obtain this result for an elementary school teacher on a microdiscectomy case with a good recovery. Client was ecstatic and Kevin volunteers on an annual basis at this client’s school for their career day.

A police officer’s life was tragically cut short when a sleep deprived trucker merged into oncoming traffic and smashed into him. Kevin helped uncover the truth about the trucker’s delinquent history and helped apply pressure to receive this result for the family.
